Welcome to Mucks Pickleball & Social Club ("Mucks," "we," "us," or "our"). By using our website, mobile applications, online registration tools (including PodPlay), or participating in our programs, leagues, clinics, events, or other services, you agree to the following Terms of Service.

1. Eligibility

• Participants must be at least 18 years old to register independently.
• Individuals under 18 ("Minors") may participate in approved programs, clinics, or leagues only with the consent of a parent or legal guardian.
• A parent or legal guardian must complete the registration, accept these Terms, and sign the Waiver & Assumption of Risk on behalf of the Minor.
• By registering a Minor, the parent/guardian represents that the Minor is physically able to participate and agrees to supervise the Minor's compliance with these Terms.
• By using our services, you represent that all information you provide is accurate, current, and complete.

2. Account Registration

• Certain services, including league or clinic registration, require creating an account via PodPlay.
• You are responsible for maintaining the confidentiality of your account login and password.
• You agree to notify Mucks immediately of any unauthorized use of your account.

3. Use of Services

• All participants must follow Mucks rules, PodPlay rules, and posted court regulations.
• Singles and doubles play may be organized via PodPlay for leagues and open play.
• You agree to play safely and respect other participants, staff, and property.
• Mucks reserves the right to suspend or terminate access for conduct that is unsafe, abusive, or disruptive.
• Conduct Clause for Minors: Parents/guardians are responsible for ensuring their child abides by club rules.

4. Payments & Refunds

• Payment for leagues, clinics, or events is processed via our service providers (GoTab, Stripe, ICT, PodPlay).
• Refunds are subject to our Refund Policy and may be partial or denied depending on timing and circumstances.
• You agree to pay all fees associated with your registration in a timely manner.

5. Waiver & Assumption of Risk

Pickleball involves physical activity. By participating in any program, clinic, league, lesson, or event offered by Mucks, you voluntarily assume all risks of injury, illness, or harm.

• You acknowledge that participation is entirely voluntary and that you are physically able to participate.
• You understand and accept the inherent risks associated with pickleball and related activities, including but not limited to slips, falls, collisions with other players, equipment malfunctions, and other unforeseen accidents.
• This release and waiver includes, without limitation, any and all claims arising from the negligence of Mucks, its staff, volunteers, or service providers, to the fullest extent permitted by law.
• All participants agree to indemnify, defend, and hold harmless Mucks, its staff, volunteers, and service providers from and against any and all claims, demands, or causes of action brought by third parties arising out of participation.
• You release Mucks, its staff, volunteers, and service providers from liability for any injuries, accidents, losses, or damages arising from participation, except where prohibited by law.

Minors

• For participants under 18 years of age ("Minors"), a parent or legal guardian must complete registration and accept these Terms on the Minor's behalf.
• The parent or legal guardian acknowledges and agrees that pickleball involves inherent risks of injury, illness, or harm. By permitting the Minor to participate, the parent/guardian voluntarily assumes all such risks on behalf of the Minor.
• The parent or legal guardian releases, indemnifies, and holds harmless Mucks, its staff, volunteers, and service providers from liability for any injuries, accidents, losses, or damages arising from the Minor's participation, including those arising from the negligence of Mucks, its staff, volunteers, or service providers, except where prohibited by law.

Severability

If any portion of this Waiver & Assumption of Risk is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

6. Intellectual Property

• All content on the website, apps, and marketing materials (text, images, logos) is owned by Mucks or our partners.
• You may not reproduce, distribute, or use content for commercial purposes without written permission.

7. Privacy

Your use of Mucks services is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

8. Termination

Mucks may terminate or suspend your access to services at any time, without notice, for violation of these Terms or other policies. No refunds will be provided in cases of termination due to violations.

9. Changes to Terms

Mucks reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with the new "Effective Date."

10. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any dispute, claim, or controversy arising out of or relating to these Terms or participation in Mucks programs shall first be submitted to good faith mediation in Ontario. If the matter is not resolved through mediation, it shall be submitted to binding arbitration under the Arbitration Act, 1991 (Ontario). The arbitration shall take place in Hamilton, Ontario, before a single arbitrator mutually agreed upon by the parties, and the arbitrator's decision shall be final and binding. Participants (and, in the case of Minors, their parent/guardian) waive any right to pursue claims through the courts, except as required by law to enforce an arbitration award.
